1.Overview
ListingLab ("we," "us," "our") provides automated audit and optimization services for short-term rental listings on Airbnb, VRBO, and similar platforms. These terms govern your use of our website, tools, and subscriptions. By using the service, you agree to these terms.
This document uses plain language on purpose. If something is unclear, email hello@yourlistinglab.com and we'll explain.
ListingLab is operated by Michael McCrea as a sole proprietorship based in Arizona, United States. The business may incorporate or restructure in the future. If it does, these terms transfer automatically to the new entity.
2.What we provide
We offer three types of service:
- Free audits — One audit per email/listing per 7-day period. A limited-scope analysis meant to demonstrate value.
- One-time paid audits — Single ($49) and Pro ($149). Deeper analysis with complete findings and recommendations.
- Pulse subscriptions — Recurring monthly plans (Pulse, Portfolio, Concierge) that include a monthly allotment of audit credits, listing tracking, and other features.
Features, pricing, and tier contents may change. Existing subscribers keep their current benefits through at least their next billing cycle after any announced change.
3.One-time audits
When you purchase a one-time audit, we run our analysis pipeline on the listing URL you provide. You get:
- A detailed written report emailed to you within the timeframe promised at checkout
- A hosted web version of the report accessible via a link for at least 90 days after generation
- The right to use, share, and act on the findings however you see fit
Audits are based on publicly available data from the listing platform at the time the audit runs. We don't guarantee that specific findings will result in specific business outcomes (more bookings, higher revenue, etc.). The service provides analysis and recommendations; execution is your responsibility.
4.Pulse subscriptions
What's included
Each Pulse tier includes a fixed number of audit credits per month, a maximum number of tracked listings, and other features as listed on the Pulse page. Credits reset to the tier's monthly allotment on each billing date and do not roll over between periods.
Auto-renewal
Pulse subscriptions automatically renew every month on the date you first subscribed, charging the payment method on file. This continues until you cancel. You'll receive an email receipt after each successful charge.
Concierge minimum commitment
The Concierge tier requires a 3-month minimum commitment. If you cancel within the first three months, you'll continue to be billed and receive service for the remainder of the 3-month period. After the initial 3 months, Concierge becomes month-to-month like the other tiers.
Tier changes
You can upgrade or downgrade between tiers through the Customer Portal. Upgrades take effect immediately with prorated charges; downgrades take effect at your next billing date. Credit balances from a higher tier are not retroactively reduced when you downgrade mid-period.
Launch pricing
If you subscribed at "launch pricing" or "founder's pricing," you'll continue to pay that rate for as long as your subscription remains active and uninterrupted. If you cancel and resubscribe later, you'll be subject to current pricing at that time.
5.Billing & payment
All charges are processed by Stripe. We don't store credit card information on our servers. You can update your payment method at any time through the Customer Portal.
All prices are in U.S. dollars and exclude applicable sales tax, which will be added at checkout where required.
If a recurring charge fails, we'll attempt to collect payment up to three additional times over approximately one week (managed automatically by Stripe). If we can't collect payment, your subscription will be marked "past due" and audit access will be suspended until payment is received. If payment can't be collected within ~2 weeks, the subscription will be cancelled.
6.Refunds
One-time audits
We'll refund a one-time audit in full if:
- The audit didn't complete due to a technical failure on our end (e.g., scraping error, pipeline crash, missing report)
- You didn't receive the audit within 72 hours of payment despite our stated delivery timeframe
- The listing URL provided couldn't be processed AND we failed to notify you and offer a corrected URL within 24 hours
We generally don't refund because:
- You disagreed with the findings or recommendations
- You implemented the recommendations and didn't see results
- You changed your mind after receiving the audit
Pulse subscriptions
Subscription refunds follow the same principle — we refund when we fail. If our service is unavailable or broken for extended periods during your billing cycle, email us and we'll prorate or credit accordingly. We don't refund unused credits from a period you paid for.
To request a refund, email hello@yourlistinglab.com with your order or subscription details. We respond within 2 business days.
7.Cancellation
You can cancel your Pulse subscription anytime from the Customer Portal. Here's what happens:
- Your subscription stays active until the end of your current paid billing period
- You keep access to your credits and features during that period
- You won't be charged for the next period
- Credits remaining at cancellation are forfeited when the period ends (they don't transfer to future subscriptions if you resubscribe)
- Concierge: if you cancel within your 3-month minimum, you'll continue being billed monthly for the remainder of the 3 months
We don't require you to contact us to cancel. The Customer Portal is self-service. We will never make cancellation harder than subscribing.
8.Acceptable use
By using ListingLab, you agree not to:
- Submit listings you don't own or don't have permission to analyze on behalf of the owner
- Use the service to scrape, reverse-engineer, or rebuild our analysis pipeline
- Share your subscription access with people outside your team in a way that exceeds the tracked-listing or credit allowance
- Use the service for fraudulent, illegal, or harmful purposes
- Abuse rate limits (e.g., submitting many free audits using different emails for the same listing)
We may suspend or terminate accounts engaged in any of the above without refund.
9.Ownership & intellectual property
Your content
Your listings, photos, descriptions, and any information you submit remain yours. We only use them to run the audit you requested and for internal service improvements (e.g., making our analysis better over time).
Our output
The audit reports we generate for you are yours to use, share, and act on without restriction. You don't need to credit us. We retain copies of reports we've generated for our records.
Our platform
The ListingLab website, analysis methodology, code, and brand are ours. You agree not to copy, resell, or repackage the service itself.
10.Disclaimers
ListingLab is not affiliated with, endorsed by, or connected to Airbnb, VRBO, or any other listing platform. All platform names are trademarks of their respective owners.
Our audits provide analysis and recommendations based on publicly available information and our methodology. We don't guarantee specific outcomes from following our recommendations. Host performance depends on many factors beyond a listing's optimization (market conditions, seasonality, pricing, operational quality, etc.).
We do our best to keep the service accurate and available, but we can't guarantee uninterrupted uptime. Platforms change their websites, scrapers break, third-party services go down. We fix issues as quickly as we can.
11.Limitation of liability
To the extent permitted by law, ListingLab's total liability to you for any claim related to the service is limited to the amount you paid us in the 12 months before the claim arose. If you haven't paid us anything, our liability is limited to $50 USD.
We're not liable for indirect, consequential, or incidental damages (e.g., lost bookings, lost revenue, business interruption) even if we've been advised of the possibility of such damages.
These limits reflect the small-business nature of ListingLab and the generally low price of the service. They don't apply to cases of gross negligence, willful misconduct, or where prohibited by law.
12.Termination
We can suspend or terminate your access if you violate these terms, abuse the service, or engage in fraudulent behavior. In cases of clear policy violation (see Acceptable use), we may terminate without refund.
If we shut down the service entirely, we'll provide at least 30 days notice, stop new charges immediately, and refund any prepaid subscription time you haven't used.
13.Privacy
We collect the minimum information needed to deliver the service:
- Your email and name (to send audits and account communications)
- Listing URLs you submit (to run the audits)
- Payment information via Stripe (we don't store cards ourselves)
- Analytics about how the website is used (page views, conversion events)
We don't sell your data. We don't share it with third parties except as needed to provide the service (Stripe for payments, Resend for emails, Vercel for hosting, Supabase for data storage, Apify for scraping, Anthropic for AI analysis). We use Plausible and Meta Pixel for analytics; you can block these with a browser extension if preferred.
Email us at hello@yourlistinglab.com if you want your data deleted. We'll do it within 30 days.
14.Changes to these terms
We may update these terms as the service evolves. For material changes (pricing structure, refund policy, liability terms), we'll notify active subscribers by email at least 14 days before the change takes effect. Minor clarifications may happen without notice.
Continued use of the service after a change means you accept the updated terms. If you don't accept a change, cancel your subscription before the effective date.
15.Governing law & disputes
These terms are governed by the laws of the State of Arizona, United States, without regard to conflict of laws principles.
If we have a dispute, we both agree to try to resolve it informally first by emailing each other. If that doesn't work, we agree to resolve disputes through binding arbitration in Arizona rather than court, except that either party may bring a claim in small claims court if eligible.
Class action waiver: Any arbitration or legal proceeding will be conducted on an individual basis, not as part of a class action.
